Public Offer (Agreement) for the Purchase of Purps Packs

Purpy Limited Liability Partnership, BIN 260740011419 (the "Seller"), hereby offers any individual with full legal capacity (the "Buyer") to conclude an agreement for the purchase of Purps packs of the Purpy service on the terms set out below.

This document is a public offer under paragraph 5 of Article 395 of the Civil Code of the Republic of Kazakhstan. Payment by the Buyer for the selected Purps pack constitutes full and unconditional acceptance of the offer (paragraph 3 of Article 396 of the Civil Code of the Republic of Kazakhstan).

1. Definitions

1.1. Service (Purpy) — the interactive-story platform available at https://purpy.app, in the editor at https://studio.purpy.app and in the Telegram mini app, of which the Seller is the rights holder and operator.

1.2. Account — the Buyer's user account in the Service.

1.3. Purps — internal conditional accounting units of the Service shown on the Account balance and intended solely for obtaining access to additional features of the Service. Purps are not money, electronic money, securities, digital assets or a means of payment, have no monetary denomination, cannot be exchanged for money, cannot be withdrawn and cannot be transferred to other users except where expressly provided by the features of the Service (Section 5). By purchasing Purps, the Buyer obtains a limited, non-exclusive, non-transferable, revocable right (licence) to use them in the Service; ownership of Purps does not pass to the Buyer.

1.4. Purps Pack — a fixed number of Purps that the Buyer purchases for a fee at the price published on the Pricing page.

1.5. Payment Page — the secure page of the acquiring bank, ДО АО «Банк ВТБ (Казахстан)» (the "Bank"), on which the Buyer enters bank card details.

1.6. Author — a user of the Service who has published an interactive story.

1.7. Bonus Purps — Purps credited without payment: under promotions, promo codes or as compensation, as well as Purps received by an Author from other users.

2. Subject of the agreement

2.1. The Seller, for a fee, credits the selected Purps Pack to the balance of the Buyer's Account, and the Buyer pays for it on the terms of this offer.

2.2. By purchasing Purps, the Buyer obtains the ability to use them to access the additional features of the Service listed in Section 5. The basic features of the Service (reading free stories, creating and publishing stories) are provided free of charge.

2.3. In all other respects, use of the Service is governed by the Terms of Service and the Privacy Policy, which form an integral part of this agreement.

3. Acceptance of the offer and conclusion of the agreement

3.1. The agreement is deemed concluded upon successful payment for the Purps Pack on the Payment Page. By pressing the "Buy" button in the Purps shop and paying for the order, the Buyer confirms that they have read the terms of this offer and the Refund Policy and accept them in full.

3.2. The Buyer must be signed in to the Account to make a purchase. Each paid order is a separate agreement.

3.3. By accepting the offer, the Buyer confirms that they are at least 18 years old or that the purchase is made with the consent of their parent or other legal representative (Section 9).

4. Price and payment procedure

4.1. The price of Purps Packs is set in Kazakhstani tenge (KZT) and shown on the Pricing page and in the Purps shop, VAT included. The Buyer may pay for a Purps Pack in Kazakhstani tenge (KZT) or in Russian rubles (RUB). The price in Russian rubles is determined by converting the tenge price at the official exchange rate of the National Bank of the Republic of Kazakhstan on the transaction date and is shown to the Buyer before payment is confirmed. The following prices apply on the publication date:

• 20 Purps — 1 007 ₸
• 50 Purps — 2 067 ₸
• 120 Purps — 4 187 ₸
• 270 Purps — 8 427 ₸

4.2. The Seller may change prices unilaterally. New prices apply to orders placed after their publication and do not affect orders already paid.

4.3. Payment is made by a Visa, Mastercard or Mir bank card on the Bank's Payment Page in Kazakhstani tenge or Russian rubles. Where payment is made in Russian rubles, the payment amount is determined at the official exchange rate of the National Bank of the Republic of Kazakhstan on the transaction date (clause 4.1). Card details are entered directly on the Bank's Payment Page, are not transmitted to the Seller and are not stored by the Seller. 3-D Secure technology may be used to confirm the payment.

4.4. The Buyer's payment obligation is deemed fulfilled when the Seller receives confirmation of successful payment from the Bank.

4.5. Any fees of the bank that issued the Buyer's card, as well as exchange differences arising where the card account currency differs from the payment currency (tenge or rubles), are determined by the Buyer's bank and are not charged by the Seller.

5. Crediting and use of Purps

5.1. Purps are credited to the Account balance automatically immediately after confirmation of successful payment is received from the Bank. Crediting confirms that the paid digital balance has been provided. Individual features of the Service are provided when Purps are subsequently spent. This does not exclude the Buyer's mandatory rights or the right to a refund for an unused pack under Section 6.

5.2. If Purps have not been credited to the balance after money was debited from the card, the Buyer must contact support at support@purpy.app, stating the Account e-mail or name and the date, time and amount of the payment.

5.3. Purps may be used to:

• opening an additional story branch — 5 Purps per branch;

• opening all additional story branches at once — with a 30% discount off the total cost of the branches;

• sending internal support to the Author — from 5 to 500 Purps per send.

5.4. Purps spent by the Buyer on unlocking branches or supporting an Author are credited to the Account balance of the relevant Author as Purps. Purpy retains the share shown in the interface before the operation is confirmed, and the remainder is credited to the Author in Purps. The Author receives no cash payment; such an operation is not a donation, a tip or remuneration for work. Purps cannot be withdrawn or exchanged for money by either the Buyer or the Author.

5.5. Access to an unlocked branch is retained while the story is lawfully available and the Buyer's Account is active. If a story is removed through no fault of the Buyer, Purpy, at its reasonable discretion, restores access, returns the spent Purps or provides an equivalent replacement, except where unlawful content is removed and a refund is restricted by law.

5.6. Purps are spent in the order in which they were purchased: Purps from the Pack purchased earlier are spent first. Bonus Purps are spent after all purchased Purps have been used, unless stated otherwise when they are credited.

5.7. Bonus Purps have no monetary value, are not subject to refund, compensation or exchange for money, and may have a validity period stated when they are credited. The Seller may cancel Bonus Purps credited in error or as a result of abuse.

5.8. If the Buyer does not sign in to the Account for more than 365 consecutive days, the Seller may close the Account in the manner provided by the Terms of Service. In that case unused Purps and unlocked access are cancelled without compensation, unless mandatory provisions of law provide otherwise.

6. Refunds

6.1. Refunds are made in the manner set out in the Refund Policy, which forms part of this agreement. In brief:

• Purps spent on unlocking branches or supporting an Author are not refundable, as the service has been provided;
• a Purps Pack from which no coin has been spent may be refunded in full on request within 14 days of the purchase date;
• in the event of a duplicate charge, a payment error or failure to credit Purps, the money is always refunded;
• Bonus Purps are not refundable.

6.2. Refunds shall be made to the bank card or other payment instrument used for the original payment within 10 business days after the refund request is approved.

Refunds are made in the currency of payment. If the payment was made in a currency other than Kazakhstani tenge or Russian rubles (for example, US dollars or euros), the refund shall be made in that same currency. The refund amount is calculated based on the amount actually paid and converted at the official exchange rate effective on the date of refund, not the date of purchase. This means that if the exchange rate changes between the date of purchase and the date of refund, the refunded amount may differ from the original payment.

Simultaneously with the refund, the corresponding Purps shall be deducted from the Account balance.

7. Rights and obligations of the parties

7.1. The Seller undertakes to:

• credit the paid Purps Pack to the balance of the Buyer's Account;
• ensure that Purps can be used in accordance with Section 5;
• review refund requests within 3 business days and claims within 10 business days of their receipt;
• refund money in the cases provided by the Refund Policy;
• ensure the confidentiality of the Buyer's personal data.

7.2. The Seller may:

• change the list and price of features available for Purps, publishing the changes in the Service;
• suspend the Service for technical maintenance;
• restrict access to the Account and block Purps in the event of a breach of the Terms of Service, fraud, a payment dispute without lawful grounds or use of another person's bank card.

7.3. The Buyer undertakes to:

• provide accurate data and keep access to the Account secure;
• pay only with a bank card of which the Buyer is the holder or which the holder has consented to being used;
• comply with the Terms of Service.

7.4. Where fraud, use of another person's card, a technical error or an unfounded chargeback is suspected, the Seller may temporarily freeze the disputed Purps, request confirmation and correct an erroneous credit. Final deduction of a paid balance is permitted only on lawful grounds and does not override mandatory consumer rights.

7.5. The Buyer may:

• use Purps in accordance with Section 5;
• contact support and demand a refund in the cases provided by the Refund Policy.

8. Liability

8.1. The parties are liable for non-performance or improper performance of their obligations in accordance with the legislation of the Republic of Kazakhstan.

8.2. The Seller is not liable for the impossibility of payment or for delays caused by the actions of the Bank, the Buyer's bank, payment systems or telecommunications operators, or for the consequences of the Buyer giving third parties access to the Account.

8.3. The Service is provided "as is". The Seller makes reasonable efforts to keep the Service running without interruption but does not guarantee the absence of technical failures. In the event of a failure as a result of which paid Purps were not credited or were incorrectly deducted, the Seller restores the balance or refunds the money.

8.4. The Seller's liability for each order is limited to the amount actually paid by the Buyer for the relevant Purps Pack, unless the legislation of the Republic of Kazakhstan provides otherwise.

8.5. The parties are released from liability for non-performance of obligations caused by force majeure.

9. Minors

9.1. The Service is intended for users aged 13 and over.

9.2. This offer is accepted by a person who has reached the age of 18. Persons under 18 may purchase Purps only with the consent of a parent or other legal representative. By making a payment, a minor confirms that such consent has been given. The minor's legal representative is responsible for the minor's purchases.

9.3. A legal representative who did not consent to a purchase may contact support in the manner provided by the Refund Policy.

10. Personal data

10.1. The Seller processes the Buyer's personal data in accordance with the Law of the Republic of Kazakhstan "On Personal Data and Their Protection" and the Privacy Policy.

10.2. Bank card data are processed by the Bank and are not stored by the Seller. The Seller receives from the Bank only information on the status and amount of the payment needed to credit Purps and make refunds.

11. Dispute resolution

11.1. This agreement is governed by the law of the Republic of Kazakhstan.

11.2. Disputes are resolved through negotiations. A claim is sent to support@purpy.app and is reviewed within 10 business days of its receipt.

11.3. If a dispute is not settled through negotiations, it is referred to the court at the Seller's location (Almaty), subject to the jurisdiction rules established by the consumer protection legislation of the Republic of Kazakhstan.

11.4. Claims and demands relating to an order are submitted to the Seller within 1 (one) year from the day the Buyer learned or should have learned of the violation of their right. After that period the Seller may refuse to satisfy them, to the extent permitted by mandatory provisions of law.

12. Term and amendment of the offer

12.1. The offer is valid from the date of its publication until it is withdrawn by the Seller.

12.2. The Seller may amend the terms of the offer unilaterally without prior notice to the Buyer by publishing a new version at https://purpy.app/offer. The new version applies to orders paid after its publication. The terms of orders already paid do not change.
